As academies have the status of independent schools, they can operate outside the School Teachers' Pay and Conditions Document (STPCD). If you work at a school that converts to become an academy then you will have protection of your pay and conditions under the Transfer of Undertakings (Protection of Employment) (TUPE) legislation. The Department for Education (DfE) states that it is "the responsibility" of the academy to agree levels of the pay with its employees. Although, in almost all cases, academies claim they pay according to their own scale, in practice these bear a close resemblance to the provisions of the STPCD.
Teachers who work or who are planning to work for an academy should check with the school if salaries are in accordance with the STPCD. You may need to refer to both the maintained sector pay scales as well as pay advice for the independent sector using the links on the left of this page.
Trust schools can apply to opt out of the STPCD by applying to the DfE for the power to innovate changes to pay and conditions. Although this is a power which has not yet been used, it could be used by trusts in future.
Teachers who work for trusts or foundation trusts would therefore be wise to view maintained sector pay scales as well as pay advice for the independent sector.
